Advocacy Program Update: People With Disabilities Foundation (PWDF) Files Motion for Sanctions and Enforcement of a Court Order Against the Social Security Administration (SSA)PWDF filed a motion for sanctions and enforcement of the order in the case of Valle v. Berryhill (4:16-cv-02358 JSC) stemming from the Social Security Administration’s (SSA’s) failure to pay retroactive benefits to plaintiff and attorney fees to plaintiff’s counsel for work performed at the administrative level for over a year after the court remanded the case back to the SSA for calculation and payment of benefits. In the motion, plaintiff argues that SSA, since February of 2018, has been providing Mr. Bruce with conflicting information as to what he had to do in order to get paid. The SSA continues to ignore the fee agreement between Mr. Bruce and Ms. Valle, which is in compliance with all statutory requirements. (42 U.S.C. §406(a), 20 C.F.R. § 404.1720 (Title II).) ServicesAdvocacy: PWDF advocates for Social Security claimant’s disability benefits in eight Bay Area counties. We also provide services in disability rights, on issues regarding returning to work, and in ADA consultations, including areas of employment, health care, and education, among others. There is representation before all levels of federal court and Administrative Law Judges. No one is declined due to their inability to pay, and we offer a sliding scale for attorney’s fees. Education/Public Awareness: To help eliminate the stigma against people with mental disabilities in society, PWDF’s educational program organizes workshops and public seminars, provides guest speakers with backgrounds in mental health, and produces educational materials such as videos.
